Minutes of the April 2010 Supervisors' Meeting

The Silver Lake Township Supervisors held their regular monthly meeting on Monday, April 5, 2010 at the Silver Lake Township building. Francis Fruehan called the meeting to order at 7:30 pm and everyone saluted the Flag. Francis Fruehan explained that with the resignation of Tom Swan and appointment of a  new Supervisor a new Chairman needed to be appointed.  Evan Everitt made a motion to appoint Francis Fruehan, Sandy Brink seconded, approved. Francis Fruehan made a motion to appoint Evan Everitt as Vice Chairman, Sandy Brink seconded, approved.  Francis Fruehan made a motion to accept the minutes with the correction that it will be Ordinance 34.1 which is related to COG as the enforcement agency that will be rescinded, Evan Everitt seconded, approved. Francis Fruehan made a motion to accept the minutes from the Special Meeting as read, Evan Everitt seconded, approved.  The Treasurer report was read and held for audit on a motion made by Francis Fruehan and seconded by Evan Everitt.

Public Comment:  Bill Fischer spoke regarding his request to DEP to change the Silver Lake water shed to EV (Exceptional Value).  He excluded McCormick Run Creek as it would effect the public sewer system in that area. 

There were concerns that the companies putting in the pipe line would do so on many properties through eminent domain. Bill Fisher asked that if anyone feels threatened by these individuals please contact him.  Any complaints against these companies would trigger a public hearing. 

Francis Fruehan said there is a possibility of a compressor station in the area and is looking at a noise ordinance.

Bill Fisher said that low-level radioactivity can be the result of the activity on the gas pad and recommended that radioactivity levels should be checked in the area at the time the driveway permit is issued and again when they are done. 

Road maintenance agreement versus posting/bonding of roads is being looked at.  To date nothing has been signed.  The gas companies have not been given permission to use the township roads.

As was explained at the Special Meeting Ordinance 34.1 will be rescinded.  This will take effect in 30 days.  At that time Code Inspections Inc. will be the enforcement agency.

Chief Tim Burgh gave the police report with 26 reportable incidents for the month of March.  The Chief explained that the gas trucks are not supposed to be running after dusk during the week, after noon on Saturdays and not at all on Sundays and holidays.  The police department will be continuing their training regarding this truck traffic.  He also explained that the gas company’s ATVs have no right to be driving on the roads and can only be on residents property with permission.

Resolution to appointment Michael Briechle is No. 2010-101.  The Ordinance to rescind COG as the UCC enforcement agency (No. 34.1) will be Ordinance No. 48.  Francis Fruehan made a motion to accept Ordinance No. 48 as was advertised, Sandy Brink seconded, approved.  The contract with Code Inspections Inc. will be a one-year contract and can be voided with 60 days notice which would become effective in 30 days.

Evan Everitt gave the road report.  The frost is still coming out of the ground which is making the roads very rough.  The spring equipment maintenance is being done. It was explained that a new truck is being considered to replace the 1990 Ford dumptruck.

Bids for road materials were received from Lopke and B & S Quarries.  Bids for fuels were received from Mirabito and Williams.  Only one bid was received for sluice pipes – Bradco Supply.  All bids will be carefully reviewed before a decision is a made. 

Francis Fruehan made a motion to pay the bills as submitted, Evan Everitt seconded, approved.

As there was no further business presented, the meeting was adjourned.
