Minutes of the June 2010 Supervisors' Meeting

The Silver Lake Township Supervisors held their regular monthly meeting on Monday, June 7, 2010 at the Silver Lake Township building. Francis Fruehan called the meeting to order at 7:30 pm and everyone saluted the Flag. The minutes from the May meeting were read and approved on a motion made by Evan Everitt and seconded by Francis Fruehan.  The Treasurer report was read and held for audit on a motion made by Evan Everitt and seconded by Francis Fruehan.

Public Comment:  It was asked if permits had been received for the docks being put in on Quaker Lake had been received.  The township received a permit for the Foley dock had and Francis Fruehan said County Soil Conservation had been at the other dock and assumed it was permitted. Mr. Jurista asked about the sale of Crown Vic police car.  Francis Fruehan made a motion to amend the May minutes to reflect that since no bids had been received for the sale of the Crown Victoria police car it could be sold without the bidding process and that the car was sold for $1,000 to Jim Klein, Evan Everitt seconded – minutes amended.  There were concerns with contractors leaving their equipment on SR 4002 in the Quaker Lake area.  It is difficult to see around the equipment and they have no one there to direct.  Bill Fischer asked if a number of RS’s were to set up on a property with the owner’s permission, would any regulations address this.  Francis Fruehan did not know if would come under our SALDO – probably not if there were no RV hookup.  COG does handle all sewage permits for any on-site systems, including holding tanks for modular housing units at gas well sites.   

Francis Fruehan pointed out that since July 4th falls on a Sunday, government offices are closed on  the 5th as the holiday; therefore, our July meeting will take place on Tuesday, July 6. 

Tom Jurista asked if the new trucks could fall under the lemon law since there seems to be so many problems with the emissions issues.  Evan Everitt explained that the trucks are under warranty so all work is at no cost to the township and all the trucks with the new emissions are having problems not just ours.

Francis Fruehan said they had a meeting with a representative with Municipal Solutions regarding the Posting and Bonding of township roads.  They would come in and study the roads and determine weight limita and provide us with a sample ordinance.  The cost would be $6,700.  Evan Everitt made a motion to proceed with the study, Francis Fruehan seconded, approved.  Bridgewater has already posted and bonded their roads, Jessup had their study done and can enact their ordinance at any time.  It was asked if there can be  seasonal weight limits.  Municipal Solutions has said you cannot post a road for one weight limit during the spring when roads are soft and then post for a hight limit at other times, but road can be taken on or off the list of posted roads.  Evan Everitt said PennDOT is in the process of posting and bonding certain state roads.  For township roads, local trucks could be granted a local exemption and would not have to provide a bond. 

It was asked if a 6-month audit of the township records should be done.  Francis Fruehan explained that the budget is reviewed on a monthly basis to make sure we are on track. 

Francis Fruehan stated that on May 12 the township received a letter from Chief Tim Burgh stating that on behalf of the Silver Lake Township Police Association, they intended to commence Collective Bargaining pursuant to Act 111 of 1968.  The letter stated the bargaining committee would consist of the Chief and Sgt. Moore.  Act 111 allows police to organize and collectively bargain with their employer for wages, benefits and conditions of employment.  On May 20 from 6:00 pm to 8:00pm the Supervisors met in Executive Session to review and discuss the letter and proposed agreement.  We have engaged council that specialized in labor and employment and are currently looking at our options and obligations under the law.

A new fee schedule is in the process of being drafted.  The current driveway ordinance allows for a fee schedule to be adopted through a resolution. 

Franklin Township will be holding a special meeting regarding the renewal of their police contract and will be asking for their residents comments. 

Chief Tim Burgh gave the police report with 36 reportable incidents for the month of May. 

Evan Everitt gave the road report.  About half the dirt road are done.  Patching of the tar/chip roads shortly.

Francis Fruehan made a motion to pay the bills as submitted, Evan Everitt seconded, approved.

One Assessment Permit was issued for the month of May – Gardner for a pole barn.

Kevin Duke received a fireworks permit for July 4.

As there was no further business presented, the meeting was adjourned.
